General Terms and Conditions

These general terms and conditions pertain to the online solution for sports club clothing registration, used for administering loaned (sponsored) club clothing to members.

Article 1. Definitions

  • Kledingregistratie.nl: A service provided by Bluepoint Webdesign, registered with the Chamber of Commerce under number 710.12.206, hereinafter referred to as Kledingregistratie.nl.
  • Customer: The natural or legal person who has entered into a subscription agreement with Kledingregistratie.nl.
  • Service: Kledingregistratie.nl provides and maintains an online solution for sports club clothing registration via the internet. The service includes at least one primary user.
  • Administration: All data entered by the Customer or generated by Kledingregistratie.nl.
  • Agreement: The agreement for the use of the Service by a Customer.
  • Party: Each party to the Agreement.
  • Website: “Kledingregistratie.nl” or the websites of the Service "Kledingregistratie.nl" and any other subdomains of Kledingregistratie.nl.
  • Fiscal Year: The year calculated from the day a user subscribes to the service.
  • General Terms and Conditions: These terms and conditions.

Article 2. Applicability and Execution

These General Terms and Conditions apply to all offers, Agreements, and deliveries by Kledingregistratie.nl, unless otherwise agreed in writing. Kledingregistratie.nl is entitled to engage third parties for the execution of (parts of) its Agreements.

Article 3. Fees

  • Fees are in euros, including VAT and other government-imposed levies.
  • All prices on the Website, brochures, newsletters, and other communications are subject to typographical and calculation errors. We accept no liability for the consequences of such errors.
  • Kledingregistratie.nl may change rates during the term of the Agreement. Any increase will never exceed the indexation of the Consumer Price Index (CPI) over the preceding years. Changes will be communicated in writing (by email) to the Customer at least two months before implementation. If the Customer disagrees with the changes, they may terminate the Agreement at the start of the new fiscal year.
  • Customers may withdraw from their subscription within two weeks of purchase, minus a €75.00 setup fee.
  • Refunds on extra fields and/or custom work are not possible.

Article 4. Establishment of the Agreement

A Customer can enter into an Agreement with Kledingregistratie.nl by subscribing via the registration form on the Website. The Customer can request changes to the number of required fields and users via support. Kledingregistratie.nl reserves the right to refuse a Customer without providing a reason.

Article 5. Access and New Versions

Kledingregistratie.nl grants the Customer access to the Service for the duration of the Agreement. The Customer receives a username and password to use the Service. Kledingregistratie.nl may periodically update the software to improve functionality and correct errors. If an update significantly changes functionality, the Customer will be informed through news updates. As the Service is provided to multiple Customers, individual Customers cannot opt out of specific changes. Kledingregistratie.nl is not liable for damages resulting from Service modifications.

Article 6. Terms of Use

  • The Customer determines what information is stored and/or exchanged using the Service. Kledingregistratie.nl has no knowledge of this information and is not liable for its legality or any third-party rights infringement.
  • The Customer must notify Kledingregistratie.nl of any changes in name, email addresses, and other relevant details electronically via the Service.
  • The Customer must use the Service responsibly and not unlawfully.
  • The Customer may grant additional users access to the Service.
  • The Customer may not offer the Service as their own.
  • If the Customer violates these Terms, Kledingregistratie.nl reserves the right to suspend or terminate the Agreement without being liable for damages or refunds.

Article 7. Maintenance

Kledingregistratie.nl aims to keep the Service available 24/7. For maintenance, modifications, or improvements, Kledingregistratie.nl may temporarily take the Service offline. Where possible, this will be done outside office hours, and the Customer will be notified via login screens and news updates. Kledingregistratie.nl is not liable for damages resulting from Service downtime.

Article 8. Support

Kledingregistratie.nl provides Customer support through a knowledge base and email. While we strive to respond adequately and within a reasonable timeframe, we do not guarantee the accuracy or completeness of responses. Support is limited to functional aspects of the Service.

Article 9. Payment

  • The Service fee includes at least the cost of one primary user. Additional fields, users, and services are charged separately.
  • The total fee is determined after manual confirmation or activation of the Service, including any additional services requested by the Customer.
  • The Customer agrees to electronic invoicing.
  • The payment term for extra fields and users is 14 days upon invoice issuance.
  • Kledingregistratie.nl reserves the right to suspend or terminate the Agreement if payments are not made on time.

Article 10. Intellectual Property Rights

All intellectual property rights related to the Service belong exclusively to Kledingregistratie.nl. The Customer receives a non-exclusive, non-transferable right to use the Service as per these Terms. Kledingregistratie.nl may implement technical measures to protect the Service. The Customer may not remove or bypass these protections.

Article 11. Liability

  • Kledingregistratie.nl is not liable for indirect damages incurred by the Customer or third parties.
  • Liability per incident is limited to the amount paid by the Customer for the Service in the past two months (excluding VAT).
  • The Customer indemnifies Kledingregistratie.nl against third-party claims related to the Agreement or Service.

Article 12. Privacy and Data Processing

If no data processing agreement is signed, the following applies:

  • The Customer is the data controller, and Kledingregistratie.nl is the data processor under the General Data Protection Regulation (GDPR).
  • Kledingregistratie.nl may process data using affiliated entities and third parties inside and outside the EU.
  • Kledingregistratie.nl ensures appropriate security measures for data stored within the Service.
  • The Customer must enter personal data into the Service lawfully.
  • In case of a data breach, Kledingregistratie.nl will respond with the highest priority and notify the Customer as soon as possible.

Article 16. Duration, Automatic Renewal, and Termination

  1. The Agreement is valid for one year.
  2. The Agreement is automatically renewed for one year unless the Customer terminates at least one month before renewal.

  4. The annual subscription fee will be automatically charged via Mollie Recurring unless the Customer has canceled in time.
  5. In case of non-payment, Kledingregistratie.nl reserves the right to restrict access or terminate the Agreement.
  6. Kledingregistratie.nl will delete the Customer's Administration two months after termination unless legal obligations require a longer retention period.

Article 17. Amendments to the Terms

Kledingregistratie.nl may modify these Terms. Dutch law applies. Disputes will be submitted to the competent court in Amsterdam.
